Ballyfin Giveaway Terms and Conditions

The Ballyfin Demesne Giveaway (the "Giveaway") is open to legal residents of the United States who are at least 18 years old at the time of entry. Employees of Skylark, Ovation, Amex GBT, and their immediate families are not eligible to participate. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.

The Giveaway is sponsored by Skylark (the "Sponsor"), located at 666 Third Ave, NYC, NY, 10017.

Participation in the Giveaway constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

The Giveaway begins on August 12th, 2024 at 3:00 PM ET and ends on August 26th, 2024 at 3:00PM ET (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible.

To enter the Giveaway, follow these steps:

No purchase is necessary to enter or win. A purchase does not increase your chances of winning.

One (1) winner will receive a stay at Ballyfin Demesne valued at approximately $4,000+. The prize includes 2 nights at Ballyfin Demesne, based on double occupancy. The prize does not include flights; the winner is responsible for their own travel arrangements and flight purchases. Additionally, the winner will be responsible for any local or city taxes and fees that may be incurred at the hotel. Should the winner wish to include more than two guests in their booking, additional charges may apply. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.

The prize must be redeemed and all travel must be completed by December 18, 2024. The winner must book their stay at least one week in advance of their desired travel dates. Availability for redeeming this prize is subject to the discretion of the hotel and may be limited, especially during peak travel periods or special events. It is advised that the winner contact the hotel early to increase the likelihood of securing their preferred travel dates. The Sponsor is not responsible for the availability of desired travel dates but will assist the winner in booking their stay within the given constraints.

The winner will be selected randomly from all eligible entries received during the Entry Period. The drawing will be conducted within 1 day after the end of the Entry Period. The winner will be notified via direct message on Instagram by the Sponsor’s account (@skylark). The winner must respond to the direct message within 48 hours to claim the prize. If a potential winner cannot be contacted, fails to respond within the required period, or the prize is not booked within the travel period, the potential winner forfeits the prize.

The winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The winner may be required to sign and return an affidavit of eligibility, release of liability, and a publicity release (except where prohibited), which must be received by the Sponsor within 7 days of the date notice or attempted notice is sent, to claim the prize. If the winner fails to sign and return the required documents within the specified period, the winner forfeits the prize.

The Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner.

By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, Instagram, and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.

THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in New York having jurisdiction.

The Giveaway hosted by Skylark is not sponsored, endorsed, administered by, or associated with Instagram.

The Sponsor is not responsible for typographical or other errors in the offer or administration of the Giveaway, including but not limited to errors in advertising, the Official Rules, the winner's selection and announcement, or the prize's distribution. The Sponsor reserves the right to correct any typographical, printing, computer programming, or operator errors, including without limitation computer errors that erroneously award prizes.
